JAHSING 3 Terms and Conditions of Use

PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY. By downloading, installing, accessing, or using the JahSing 3 media player and library manager (“JahSing 3,” the “Software,” or the “App”), and by creating or using a jahsing.com account in connection with it, you (“User,” “you”) agree to be bound by these Terms and Conditions (the “Terms”). These Terms are entered into between you and Eschateq Ltd. (“Eschateq,” “we,” “us,” or “our”), a corporation existing under the laws of Ontario, Canada. If you do not agree to these Terms, do not download, install, or use JahSing 3.

1. Overview of the Software

JahSing 3 is a cross-platform media player and personal media library manager developed by Eschateq Ltd., available for Windows, macOS, Linux, iOS, and Android. JahSing 3 is local-first: it indexes and plays media stored on your own device, works fully offline, and does not transmit your local media library to Eschateq. The basic version of JahSing 3 is provided free of charge and includes its core functionality. This free core app is supported by advertising, with advanced, account-based features available through a paid subscription (“JahSing 3 Pro”), as described in Section 3.

Core, no-charge functionality of JahSing 3 includes, without limitation:

Local playback of MP3, FLAC, Ogg Vorbis, WAV, AAC, ALAC/M4A files, and .mod/.xm/.s3m/.it tracker modules, through a single gapless playback queue;
A locally indexed media library with search, sorting, filtering, playlists, and favourites;
Access to internet radio stations via the public radio-browser.info directory, including live “now playing” metadata;
Podcast search, subscription, and playback, with resume position, via user- or third-party-supplied RSS feeds;
Time-synced and plain-text lyrics retrieved from the third-party service lrclib.net;
A tag editor for ID3, Vorbis comment, and MP4 atom metadata, with cover-art lookup via the MusicBrainz Cover Art Archive;
A ten-band graphic equaliser with preamp, stereo balance control, and a pop-out video window;
A “Discover” tool that extracts playable audio/video links from a user-supplied web page or remote .pls/.m3u playlist; and
A classic Winamp® 2 (.wsz) skin engine, including the bundled “Kanata stone” skin and support for user-supplied third-party skin files.

No jahsing.com account is required to use the core, offline functionality of JahSing 3 described above. An account is required only to access JahSing 3 Pro features described in Section 3.

2. Account Registration

To access JahSing 3 Pro or any account-based feature, you must register for a jahsing.com account and provide accurate, current, and complete information. You are responsible for:

maintaining the confidentiality of your account credentials;
all activity that occurs under your account, whether or not authorized by you; and
notifying Eschateq promptly of any unauthorized use of your account or any other breach of security.

You must be at least the age of majority in your province or territory of residence, or have the consent of a parent or legal guardian, to create an account. Eschateq may suspend or terminate an account it reasonably believes has been used in violation of these Terms.

3. Subscriptions — JahSing 3 Pro

Eschateq offers an optional paid subscription tier, JahSing 3 Pro, which unlocks account-based advanced features not included in the free version, currently including cross-device library synchronization, casting, party listening, and priority customer support (collectively, the “Pro Features”). Additional Pro Features (such as local network discovery) may be added over time as described on the JahSing 3 website; Eschateq will identify such features as they become available.

3.1 Subscription plans

Current pricing, any promotional pricing, and full plan details are posted on the JahSing 3 store at jahsing.com/jahsing3/shop and are incorporated into these Terms by reference. Prices are subject to change on notice as described in Section 3.5.

3.2 Free trial

Each paid plan includes a fifteen (15) day free trial for new subscribers. Unless you cancel before the trial period ends, your chosen plan will automatically convert to a paid, auto-renewing subscription and your designated payment method will be charged. Eschateq reserves the right to limit free-trial eligibility to one trial per person or account.

3.3 Billing and auto-renewal

Subscriptions are billed in advance on a recurring basis (monthly or annually, per your selected plan) and automatically renew for successive periods of the same length unless you cancel before the end of the then-current billing period. By subscribing, you authorize Eschateq (or its third-party payment processor) to charge your payment method on each renewal date.

3.4 Cancellation and refunds

You may cancel your subscription at any time through your jahsing.com account settings. Cancellation takes effect at the end of the then-current billing period; Pro Features remain available until that date. Except where required by applicable law, fees already paid are non-refundable, including for partial billing periods or unused Pro Features.

3.5 Changes to plans, pricing, or features

Eschateq may add, modify, or discontinue Pro Features, and may change subscription pricing, on reasonable advance notice posted on the JahSing 3 website or sent to your registered email address. Price changes will take effect no earlier than your next renewal date.

4. Free vs. Subscription Services — Summary

For clarity, the following is provided without a subscription and without a jahsing.com account:

The complete local playback engine, library indexing, playlists, favourites, tag editor, equaliser and balance, video window, tracker-module playback, and classic Winamp skin engine;
Internet radio search and playback via radio-browser.info, and podcast subscription and playback via user-supplied RSS feeds;
Synced lyrics via lrclib.net and cover-art lookup via MusicBrainz.

The following require an active JahSing 3 Pro subscription:

Removal of in-app advertising
Cross-device library synchronization;
Casting to compatible speakers/devices;
Party listening (shared/collaborative playback sessions); and
Priority customer support.

Eschateq does not guarantee that any specific feature will remain free or paid indefinitely and may reclassify features between tiers on the notice described in Section 3.5.

5. Third-Party Content and Services

JahSing 3 integrates with independent third-party services — including, without limitation, radio-browser.info (radio station directory and metadata), lrclib.net (lyrics), and the MusicBrainz Cover Art Archive (cover art) — and allows you to import content from arbitrary user-supplied web pages, RSS feeds, and playlist files (.pls/.m3u). Eschateq does not own, control, curate, or guarantee the accuracy, legality, availability, or continued operation of these third-party services or of any content, stream, feed, or file you access or import through them.

Your use of any third-party service accessed through JahSing 3 is subject to that service’s own terms and policies, and is at your own risk. Eschateq is not a party to, and has no responsibility for, any content obtained from radio stations, podcasts, imported web pages, or other third-party sources, and disclaims all liability arising from such content, including copyright, trademark, defamation, or other claims relating to it.

6. User Content and User Conduct

You are solely responsible for the media files, playlists, imported web content, skins, and other material you load into, import into, or access through JahSing 3 (“User Content”), and for ensuring you have all rights, licences, and permissions necessary to possess and play that content.

In using JahSing 3 and any related jahsing.com account or Pro Feature, you agree that you will not, and will not permit any third party to:

use JahSing 3 to reproduce, distribute, stream, or access any content in violation of copyright, trademark, or other intellectual property or proprietary rights, or in violation of applicable law;
circumvent, disable, or interfere with any content-protection, security, or technical measure of JahSing 3 or of any third-party service it connects to;
use the Discover / web-scanning feature, party listening, or casting to distribute, broadcast, or make available content to others without the necessary rights to do so;
upload, import, or share any skin, feed, playlist, or file that contains malicious code, or that is unlawful, harassing, defamatory, obscene, or otherwise objectionable;
misuse a jahsing.com account, including by sharing credentials to circumvent subscription limits, attempting to gain unauthorized access to other accounts or to Eschateq’s systems, or reverse-engineering the Software except to the extent such restriction is prohibited by applicable law; or
use JahSing 3 in any manner that infringes, misappropriates, or otherwise violates the rights of any person or entity, or that violates any applicable local, provincial, federal, or international law or regulation.

You are solely and fully responsible for your own conduct and for any content you access, import, play, stream, or share while using JahSing 3, including through party listening, casting, or any other Pro Feature that involves other users or devices.

7. No Liability for User Behaviour or User Content

Eschateq does not monitor, review, endorse, or control User Content or how any user chooses to use JahSing 3, and Eschateq expressly disclaims any and all liability, direct or indirect, arising from or relating to:

any User Content accessed, imported, played, stored, or shared by you or any other user;
any infringing, unlawful, offensive, or inappropriate conduct of any user, including in party listening sessions, casting, or any other shared or social feature;
any dispute, harm, or loss arising between users, or between a user and a third party, in connection with content or conduct occurring through JahSing 3; and
any third-party stream, feed, file, or service accessed through JahSing 3, as described in Section 5.

You agree that Eschateq acts solely as a provider of the underlying software platform, and not as a publisher, broadcaster, or curator of any User Content or third-party content, and bears no responsibility for the actions or omissions of any user of JahSing 3.

8. Intellectual Property

JahSing 3, including its software, source code, design, trademarks, the “JahSing” and “Kanata AI” names and logos, and the bundled “Kanata stone” skin, is the property of Eschateq Ltd. or its licensors and is protected by applicable intellectual property laws. Subject to your compliance with these Terms, Eschateq grants you a limited, non-exclusive, non-transferable, revocable licence to install and use JahSing 3 for your personal, non-commercial use.

Winamp® is a trademark of its respective owner; JahSing 3’s classic-skin compatibility mode is an independent, interoperable implementation and does not imply any affiliation with, sponsorship by, or endorsement from that trademark owner. Third-party skin files (.wsz) that you load remain the property of their respective creators.

9. Disclaimer of Warranties

JAHSING 3 AND ALL RELATED SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising from course of dealing or usage of trade, to the fullest extent permitted by applicable law. Eschateq does not warrant that JahSing 3 will be uninterrupted, error-free, secure, or compatible with every device or file, or that any third-party service it relies upon will remain available.

10. Limitation of Liability

To the fullest extent permitted by applicable law, in no event will Eschateq, its officers, directors, employees, or agents be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, revenue, or goodwill, arising out of or relating to your use of, or inability to use, JahSing 3, whether based in contract, tort (including negligence), strict liability, or otherwise, even if advised of the possibility of such damages.

Eschateq’s total aggregate liability to you for any claim arising out of or relating to these Terms or JahSing 3 will not exceed the greater of (a) the amount you paid to Eschateq for the JahSing 3 Pro subscription in the twelve (12) months preceding the event giving rise to the claim, or (b) fifty Canadian dollars (CAD $50). Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you.

11. Indemnification

You agree to indemnify, defend, and hold harmless Eschateq Ltd. and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with: (a) your use or misuse of JahSing 3; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any applicable law or the rights of any third party.

12. Suspension and Termination

Eschateq may suspend or terminate your access to your jahsing.com account or to JahSing 3 Pro, without notice, if it reasonably believes you have violated these Terms, engaged in unlawful conduct, or created risk or possible legal exposure for Eschateq or other users. You may stop using JahSing 3 and delete your account at any time. The core, offline functionality of JahSing 3 described in Section 1 is not conditioned on maintaining an account and is unaffected by termination of an account.

13. Changes to These Terms

Eschateq may update these Terms from time to time. Material changes will be posted on the JahSing 3 website with an updated “Last updated” date, and, where practicable, notified to registered users by email. Continued use of JahSing 3 after such changes take effect constitutes acceptance of the revised Terms.

14. Governing Law and Dispute Resolution

These Terms, and any dispute or claim arising out of or in connection with them or with JahSing 3 (including non-contractual disputes or claims), are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-laws principles.

You irrevocably agree that the courts located in the Province of Ontario, Canada shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms or JahSing 3, and you irrevocably submit to the jurisdiction of those courts and waive any objection to venue there, including on grounds of inconvenient forum.

15. General

Entire agreement: These Terms, together with any policies referenced in them, constitute the entire agreement between you and Eschateq regarding JahSing 3 and supersede all prior agreements on the subject.
Severability: If any provision of these Terms is held unenforceable, the remaining provisions will remain in full force and effect.
No waiver: Eschateq’s failure to enforce any provision is not a waiver of its right to do so later.
Assignment: You may not assign these Terms without Eschateq’s prior written consent; Eschateq may assign these Terms in connection with a merger, acquisition, or sale of assets.
Language: These Terms are drawn up in English at the express wish of the parties. Les parties confirment leur volonté que cette convention soit rédigée en anglais.

16. Advertising, Cookies and Privacy

The JahSing 3 website may display advertising served by Google and its advertising partners, and may use cookies and similar technologies for analytics and advertising. We are not responsible for the content of third-party ads or for the websites they link to, and your dealings with advertisers are solely between you and them. The free version of the JahSing 3 app also displays advertising to users without an active JahSing 3 Pro subscription; JahSing 3 Pro removes in-app advertising. How we collect, use and protect personal information, including through cookies and advertising, is described in our Privacy Policy, which forms part of these Terms.
